The terms that apply when you use this website or order treatment through Preston Sleep Clinic.

These terms and conditions, together with our privacy policy, explain the basis on which we make our website and services available to you, what we expect from you as a user, and how we treat the information you give us and the information we collect.

A few definitions used throughout: “we” and “us” means Resolve Health Group Ltd; “you” means the person visiting the site or using our services; “Site” means our website at prestonsleep.co.uk; “Service” means the specific service described in the relevant section, and “Services” means everything we offer through the Site collectively.

These documents affect your legal rights and obligations, so please read them carefully. If you do not accept them, please do not use the Site or our Services.

We may update these terms from time to time at our discretion. Updated versions take effect as soon as they are published on this page. Please check back periodically so you are aware of the current version.

Accessing our Website

The Site is intended for people living in the UK. We make no representation that its content is appropriate or available elsewhere.

You must be at least 18 years old to use the Site or purchase any product or service through it.

We may from time to time restrict access to parts of the Site, or the whole Site, to registered users.

If you choose or are given a login, password or other security credential, you must keep it confidential and not share it with anyone. We may disable any credential at any time if, in our reasonable opinion, you have breached these terms. If you know or suspect that someone else has your credentials, tell us promptly at contact@prestonsleep.co.uk.

You must not attempt to gain unauthorised access to the Site or interfere with it in any way, including hacking, denial-of-service attacks, or uploading malicious code.

About our Services

The Site provides information about sleep health and a short online triage tool. The triage tool asks a small number of questions and directs you to the service most likely to be appropriate – it does not diagnose any condition and is not a clinical assessment. We do not provide medical advice, diagnosis or treatment, and the triage tool is free to use.

We work with third parties who provide certain services and products to you directly, even where you reach them through our Site. In particular, clinical assessment, prescribing and the dispensing and delivery of any medicine are provided by our partner pharmacy, The Independent Pharmacy (see our Pharmacy Terms). Where a service or product is provided by a third party, your contract for it is with that third party, and their terms govern your rights to cancel, refund or change it.

We have no control over, and accept no responsibility for, the acts or omissions of third-party providers.

Wherever you use a service through the Site, you must keep your personal and medical information accurate and up to date, and answer all questions fully and honestly. This information is used to provide clinical services safely – incomplete, inaccurate or false information could put your health at risk or delay your care.

We may receive a referral fee from our partner pharmacy when you purchase treatment after following a link from our Site. This does not affect the price you pay.

How prescription treatment works

The treatment journey described in this section – including clinical assessment, identity verification, payment, any subscription, dispensing and delivery – is currently operated by The Independent Pharmacy under their own terms, which you accept when you place an order with them. The description below explains how that journey works.

Prescription treatment accessed through this Site is assessed and prescribed by UK-registered independent prescribers, regulated by the General Medical Council (GMC) or General Pharmaceutical Council (GPhC) as appropriate, and dispensed by a GPhC-registered pharmacy.

You must be between 18 and 75 years of age to use prescription treatment services.

Services are available only to people resident in the UK. Medicines cannot be sent outside the UK, and orders may be cancelled if you are located outside the UK or supply a forwarding address.

To be considered for prescription treatment you must complete a medical questionnaire covering your symptoms, medical history and current medicines. It must be completed by you, about you, and answered fully and honestly at every stage. Your answers are used by the clinical team to assess whether treatment is suitable, and false or incomplete answers could put your health at risk.

You will be asked to verify your identity, including photo ID, your full legal name, date of birth and address, so our pharmacy partner can confirm you are who you say you are and are resident at a UK address. You may be contacted if your identity cannot be verified, and orders may be cancelled if verification fails.

Payment for your first course of treatment is taken when you submit your order. Where treatment is supplied on a recurring basis, the billing schedule and initial term will be shown to you before you subscribe.

A member of the clinical team reviews your answers and assesses your suitability. You may be contacted by email for further information; if you do not respond, your request may be declined.

Requests are normally processed within 24 hours, Monday to Friday.

If the clinician decides the treatment is not suitable for you, your request will be declined and you will be told why by email. Any payment taken will be refunded and any subscription cancelled. Refunds can take up to 5 working days to reach your account, depending on your bank.

If treatment is approved, a prescription is issued in your name and passed to the partner pharmacy for dispensing and delivery.

Once an order has been processed, medicines cannot be cancelled or returned.

Professional codes of conduct and legal restrictions may limit the quantity and frequency of medicines that can be supplied to you.

You must tell the prescribing service about any change in your health, medical conditions or side effects as soon as you become aware of them, so your ongoing suitability for treatment can be assessed.

You may be contacted to confirm your continued suitability, or where your treatment plan changes (for example, a dose adjustment). If you do not respond in a timely way, the clinicians will not be able to continue prescribing.

The pharmacy reserves the right to cancel your subscription and stop supplying medicine if you report significant side effects or an adverse change in your condition, and they will cancel your subscription if you tell them you no longer wish to receive treatment.

Where treatment is supplied on a recurring basis, payment is taken 48 hours before your next dispatch.

Deliveries are made by tracked carriers and will be posted through your letterbox where possible; a signature is not normally required. You are responsible for making sure nobody else can access medicines delivered to you – take particular care if children or animals are in your household.

Deliveries may occasionally be delayed for reasons outside our control. We cannot accept responsibility for such delays but will do what we can to put things right. If your delivery is more than 7 days late, contact the pharmacy and they may arrange redelivery free of charge.

Product information on the Site is educational and we make no guarantee that it is complete, accurate or current. Always read the packaging and patient information leaflet before use. If you buy medicine in advance, check the expiry date on the box. Keep your medicines where only you can access them.

In a medical emergency, call a doctor or 999 immediately.

Complaints

If you have a concern or complaint about the Site or our Services, contact us at contact@prestonsleep.co.uk and we will aim to resolve it with you as quickly as possible.

Complaints about a consultation, prescription or delivery should go to The Independent Pharmacy at support@theindependentpharmacy.co.uk. If you’re not satisfied with their response, you can contact the General Pharmaceutical Council.

Limitation of Liability

To the fullest extent permitted by law, we and third parties connected to us exclude liability for loss or damage of any kind – including business losses such as loss of profits, income, revenue, anticipated savings, contracts, commercial opportunity or goodwill, whether direct, indirect or consequential – arising in connection with the Site, its use, inability to use it, or reliance on material published on it or on sites linked from it, whether in tort (including negligence), contract or otherwise, even if foreseeable.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

We cannot accept liability for damage resulting from: your failure to provide and maintain complete, truthful and accurate information in the information you give us or our partner pharmacy in the triage tool, any consultation, or other communications; or your failure to follow advice given to you, or to pass relevant information to your usual healthcare provider.

We do not take payment for any product or service through the Site. Our liability to you in connection with the Site is limited to £100.

Prices may change without notice. We may modify or discontinue any product or service at any time without notice, and are not liable to you or any third party for doing so.

Governing Law

These terms, their subject matter and formation are governed by English law. You and we agree that the courts of England and Wales have non-exclusive jurisdiction, except that residents of Northern Ireland may also bring proceedings in Northern Ireland and residents of Scotland may also bring proceedings in Scotland.

These terms, together with the documents expressly referred to in them, are the entire agreement between us regarding the Site and Services and supersede all prior discussions and arrangements.

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens, and the transfer will not affect your rights.

If any provision of these terms is found invalid, unlawful or unenforceable, it will be severed to that extent and the remaining provisions will continue in full force.
